1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the FixMenu website (www.getfixmenu.com) and the FixMenu web application (app.getfixmenu.com), collectively the "Service", operated by FixMenu ("we", "our", "us") from Chennai, India.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. The FixMenu Service

FixMenu is a Software-as-a-Service (SaaS) platform that helps restaurants, cloud kitchens, and food businesses analyze food cost, engineer menus, optimize pricing, and improve profit margins. The Service is provided on an "as-is" basis and may evolve over time as we add, modify, or remove features.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate, current, and complete information during sign-up.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • You may not share, transfer, or sell your account to another party.
  • You must notify us immediately if you suspect any unauthorized access.

4. Subscription & Billing

Plans

FixMenu offers a Free plan with limited features and one or more paid plans (e.g. Pro). Current pricing and feature limits are listed on our Pricing page.

Billing cycle

  • Paid subscriptions are billed in advance on a monthly basis.
  • Your subscription will automatically renew at the end of each billing period unless cancelled.
  • All payments are processed in Indian Rupees (INR) through our payment partner Razorpay.
  • Applicable taxes (GST) will be added where required by law.

Cancellation

You can cancel your subscription at any time from your account settings. On cancellation, you'll continue to have Pro access until the end of your current billing period, after which your account will revert to the Free plan.

Refunds

Refunds are governed by our Refund Policy.

5. User Responsibilities

By using FixMenu, you agree that you will:

  • Use the Service only for lawful business purposes
  • Provide accurate menu, ingredient, and pricing data
  • Comply with all applicable laws, including food safety and tax regulations
  • Take responsibility for any business decisions you make based on the Service
  • Ensure that you have the legal right to upload any data, recipes, or content into the platform

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to build a competing product
  • Attempt to gain unauthorized access to other accounts or our infrastructure
  • Upload viruses, malware, or any harmful code
  • Scrape, crawl, or harvest data from the Service using automated means without our written permission
  • Use the Service to send spam or unsolicited communications
  • Resell, sublicense, or redistribute the Service without our written consent
  • Misrepresent your identity or affiliation with any person or entity

We may suspend or terminate accounts that violate these rules, with or without notice.

7. AI Recommendations Disclaimer

Important: FixMenu uses algorithms and AI-powered models to generate insights, classifications, and recommendations (such as pricing suggestions and menu engineering scores). These are decision-support tools, not professional advice.

Recommendations are based on the data you input and statistical models. They do not guarantee specific business outcomes, profit increases, or success. You are solely responsible for any business, pricing, or operational decisions you make. We strongly recommend reviewing recommendations with your own judgment, accountant, or business advisor before acting on them.

8. Intellectual Property

All intellectual property in the FixMenu Service — including the software, branding, logos, design, text, and content (excluding your own data) — is owned by FixMenu and is protected by Indian and international copyright, trademark, and other IP laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, in accordance with these Terms. No other rights are granted.

9. Your Data

You retain full ownership of all menu data, recipes, business information, and other content you upload to FixMenu ("Your Data"). You grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.

We will not sell Your Data, share it with advertisers, or use it to train third-party AI models. Our handling of Your Data is described in our Privacy Policy.

10. Service Availability

We strive to keep FixMenu available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (announced in advance where possible)
  • Emergency fixes or security updates
  • Issues with third-party providers (e.g. hosting, payment processors)
  • Events outside our reasonable control

We are not liable for losses arising from temporary unavailability of the Service.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Service will be error-free, secure, or meet your specific business requirements.
  • FixMenu, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, revenue, data, or goodwill — arising from your use of the Service.
  • Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us for the subscription in the three (3) months immediately preceding the event giving rise to the claim.

12. Termination

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, engage in fraudulent activity, or pose a risk to the Service. Upon termination:

  • Your right to access the Service ends immediately.
  • You can request a data export within 30 days of termination.
  • After 30 days, Your Data may be permanently deleted from our active systems.
  • Sections of these Terms that by their nature should survive (e.g. IP, liability, governing law) will continue in effect.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

14. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Material changes will be notified to active users by email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
